GENERAL

Medtexter, LLC. (hereinafter “Medtexter”) has created this Privacy Policy for its Medtexter adherence solution in order to demonstrate our resolute commitment to protect your privacy and personal information. It further describes our information gathering and dissemination practices.

MEDTEXTER WILL NOT SHARE YOUR PERSONALLY IDENTIFIABLE INFORMATION WITH ANY THIRD PARTY WITHOUT YOUR CONSENT UNLESS REQUIRED BY LAW OR WHEN NECESSARY TO PROTECT OUR RIGHTS AND/OR TO COMPLY WITH A JUDICIAL PROCEEDING, COURT ORDER OR LEGAL PROCESS SERVED ON US. WE AND OUR PARTNERS MAY, FROM TIME TO TIME, SEND YOU INFORMATION THAT MAY BE OF INTEREST TO YOU BASED ON YOUR REGISTRATION PROFILE AND ACTIVE REMINDERS. YOU CAN OPT-OUT OF RECEIVING THESE COMMUNICATIONS AT ANY TIME.

MEDTEXTER ALSO OFFERS A MEANS FOR PATIENTS TO ORDER AND REFILL PRESCRIPTION AND OTHER MEDICATION(S) THROUGH AN AUTOMATED SYSTEM THAT CONNECTS ITS USERS TO THIRD PARTY VENDORS. IF YOU USE THIS SERVICE, YOU CONSENT TO MEDTEXTER PROVIDING SOME OF YOUR INFORMATION TO SUCH THIRD PARTY VENDORS FOR PURPOSES OF FACILITATING YOUR ABILITY TO ORDER AND REFILL PRESCRIPTION MEDICATION(S) THROUGH SUCH THIRD PARTY VENDORS. MEDTEXTER IS NOT A LICENSED PHARMACY AND ALL PHARMACY FULFILLMENT SERVICES ARE PROVIDED BY THIRD PARTY VENDORS AND ARE SUBJECT TO THEIR TERMS AND CONDITIONS AND NOTICES OF PRIVACY PRACTICES. MEDTEXTER’S SERVICE SERVES ONLY AS A MEANS TO CONNECT WITH THIRD PARTY PHARMACIES LICENSED TO PROVIDE MAIL-ORDER PRESCRIPTION SERVICES. MEDTEXTER DISCLAIMS ANY LIABILITY FOR SUCH PRESCRIPTION SERVICES; AND YOU AGREE THAT ANY CLAIMS RELATING TO THE PRESCRIPTION SERVICES WILL BE DIRECTED TO THE THIRD PARTY PHARMACY.

Medtexter’s website, or other websites that are powered by this service, and its applications may contain links to other websites. Medtexter is not responsible for the privacy practices or the content contained on other websites. Although every effort has been made to choose those websites and organizations that share our philosophy and strict guidelines, please read the privacy policies of those websites carefully if you have any concerns about your privacy.

INFORMATION THAT WE COLLECT FROM YOU AND HOW WE USE IT

Medtexter’s registration form requires that you provide us with contact information (e.g., name, phone number and email address), optional demographic information (e.g., location, gender and age) and condition interest levels (e.g., high blood pressure) so that we may customize your experience while using our services. We also collect medication information to develop the requested reminder messages. We use this information to send you the reminder messages you create, to contact you regarding updates, with other information regarding our services, or to provide you with materials relating to your personal areas of interest identified within your user account. It is your responsibility to maintain the accuracy of your contact and other personal information in your user account so that we may continue to send you reminders or other materials you have requested.

Medtexter may share aggregate (which means we combine all data into one large, non-personal group) information regarding our registered users with marketers; however, we never share information that identifies a specific user without that user’s consent. We do, however, reserve the right to disclose your personally identifiable information but only as required by law and when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or legal process served on Medtexter.

Once logged on to Medtexter’s service, your Internet Protocol (“IP”) Address is relayed to Medtexter. Your IP Address contains basic information about your computer including, but not limited to, geographic location, operating system, browser type and version. We use your IP Address to help diagnose problems with our server, and to administer our website and applications.

From time to time we may offer users the opportunity to participate in online surveys. Our online surveys may ask users for demographic information (e.g., age) and psychographic information (e.g., what television shows you watch) to better help us understand the answers submitted among other similar individuals in similar geographic or demographic areas. We use this data to tailor your experience, to provide content and services that we believe will be of interest to you and to enhance our product offerings in ways that we hope will better work for you and other users of our services. This information may be shared with marketers on an aggregate basis to help improve our communications to you, but information that identifies a specific user will not be shared.

HOW WE SAFEGUARD THE INFORMATION YOU PROVIDE TO US

Medtexter has implemented various security measures to protect against the unintended loss, disclosure, misuse or alteration of the information under our control while using our Medtexter service.

1. We do not store cookies on your machine. Cookies are small pieces of computer code that identify you and your computer. Many sites use cookies to identify you when you come to a website, especially if the site or application is personalized for you. Because certain types of cookies can allow other people access to your information, we have decided not to store them after you log out of your account.

2. You must log in to Medtexter’s application any time you want to access your personal information. In order to view your account on a website or on any Medtexter mobile or tablet-based application, you will be asked to log in with your email address and unique password. This password is personal to you and should not be shared with anyone. If you leave the website or application, you should be sure to log off. In the event that you forget to log off and leave your computer or if there is no activity on the Medtexter account for more than 5 minutes, you will automatically be logged off and will be asked again to log in with your password as an added measure of security.

3. All of your personal information is encrypted when it is stored in and transmitted by our system. “Encrypted” means that your personal information is “scrambled” with special complex codes so that no other individual or computer can read it without the password to “unlock” the code.

4. You have full control over your information. You can change any piece of information in your password-protected account at any time within the Profile section. Changes are processed in real time.

5. Medtexter monitors the limited number of our employees that can potentially access your information. As a part of general maintenance procedures that ensure the security of your personal information and the stability of our servers, there are a limited number of employees that may have access to our user database. These employees are required to abide by our Privacy Policy and are subject to strict disciplinary action including but not limited to termination of employment if this policy is breached; Medtexter shall also alert the appropriate authorities if any actions warrant such notification.

6. We will never ask for your password in an unsolicited phone call or email- do not ever give it out.

7. All the information Medtexter collects for its Medtexter service is hosted on secure servers stored behind firewalls that are backed up regularly to ensure minimal loss of information in the event of a system failure or disaster.

Unfortunately no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, we cannot ensure or warrant the security of any information you transmit to us or from our online products or services, and you do so at your own risk. Once we receive your transmission, it is in our interest to make best efforts to ensure its security on our systems.

NOTE THAT MEDTEXTER CANNOT PROTECT ANY INFORMATION ONCE IT HAS BEEN TRANSMITTED TO YOU. IF YOU SHARE A PHONE NUMBER OR EMAIL ADDRESS WITH ANYONE ELSE (FOR EXAMPLE, A FAMILY MEMBER), INFORMATION TRANSMITTED TO THAT PHONE OR EMAIL ADDRESS MAY BE ACCESSED BY THAT OTHER PERSON. YOU SHOULD CONSIDER ANY SHARED USE WHEN CREATING YOUR REMINDER ON THE MEDTEXTER SYSTEM.

THE HEALTH INSURANCE PORTABILITY AND ACCOUNTABILITY ACT (“HIPAA”) AND THE HEALTH INFORMATION FOR TECHNOLOGY FOR ECONOMIC AND CLINICAL HEALTH (“HITECH”) ACT

Although many people assume that HIPAA protects all personal health information, however obtained and wherever stored, HIPAA is actually somewhat limited in its applicability. HIPAA governs only “covered entities” and their “business associates.” Covered entities under HIPAA include (i) health plans (insurance companies, HMOs, etc.); (ii) health care clearinghouses (entities that convert health information into or out of standard formats for billing or other purposes); and (iii) most health care providers (physicians, hospitals, etc.). Business associates are entities that contract with covered entities to provide certain services that involve the use or disclosure of individually identifiable health information.

Medtexter is not a covered entity under HIPAA but does, in some circumstances, act as a business associate. In such circumstances, Medtexter will comply with the rules promulgated by the Department of Health and Human Services under both HIPAA and HITECH for business associates, including the rules relating to security of personal health information and requiring notification of security breaches of unsecured protected health information. CHILDREN’S GUIDELINES

Medtexter’s applications have not been built or designed for children, nor are they directed toward children. Although children may use the applications, they should not do so without the guidance and approval of a parent or guardian. Although we do not intend to collect personal information from children, we do intend to comply with state and federal law, including, without limitation, the Children’s Online Privacy Protection Act, in the event a child provides such information to us.

Please note that we have not included any safeguards to protect a child’s privacy, like parental notifications or approvals. If you notice that your child has received information you believe is inappropriate, please contact our customer service department to have your child’s name removed from our database. You can reach our customer service department by:

1. Sending an e-mail message to remove@medtexter.com with the name and date of birth of the child whose information should be deleted from our database;

2. Calling our support number at (425) 442-2083; or

3. Sending a letter with the name and address of the child whose information should be deleted from our database to the following postal address:

Medtexter solicits from you areas of interest when you register for our service. Medtexter and its partners may then provide you with targeted materials that relate to the areas that you have identified as of interest to you. You can Opt-Out of receiving these optional materials by de-selecting that option in your Profile section or by contacting our customer service department by:

1. Sending an e-mail message to remove@medtexter.com simply placing REMOVE in the subject line;

2. Calling our support number at (425) 442-2083; or

3. Sending a letter requesting to be removed from the program to:

CORRECT OR UPDATE YOUR INFORMATION

You can update your information with Medtexter’s service at any time by logging in to your account online or through our mobile or tablet-based application. Instructions for editing your account are available once you have logged onto the system.

NOTIFICATION OF CHANGES

If Medtexter decides to change its privacy policy that governs its service, we will post those changes on our website and within your account so our users are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. If at any point we decide to use personally identifiable information in a manner different from that which was stated at the time it was collected, we will notify users. Users will have a choice as to whether or not we use their information in this different manner.

NOTE: IF YOU DO NOT AGREE WITH THE MANNER IN WHICH MEDTEXTER WILL COLLECT AND USE YOUR INFORMATION AS DESCRIBED IN THIS PRIVACY POLICY, PLEASE DO NOT USE ANY MEDTEXTER SERVICES.
